Terms and Conditions – Inked Elegance LLC

Effective Date: March 14, 2025

1. Acceptance of Terms

By accessing or using the services of Inked Elegance LLC (“we,” “us,” or “our”), including our website and in-person services, you (“you” or “client”) agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Services Provided

Inked Elegance LLC provides permanent cosmetics and paramedical tattooing services, including but not limited to:

  • 3DAreola Reconstruction
  • Inkless Stretchmark Revision
  • Lip Color Enhancement
  • Scar Camouflage
  • Other paramedical and permanent makeup procedures

3. Client Responsibilities

  • You must provide accurate, complete and up to date information about your health history, medical conditions at time of consultation, booking, and prior to procedure. We are not liable for any issues arising from inaccurate or incomplete information.
  • Follow all pre- and post-procedure instructions provided by our technicians. Failure to follow these instructions may result in adverse effects, which we are not liable.
  • Contact your physician immediately of any adverse reactions or complications.
  • You are responsible for obtaining any necessary medical clearances or approvals from your physician.
  • You must be 18 years of age or older to receive these services. Minors under the age of 18 may only receive services as outlined in 25 Texas Administrative Code, RULE §229.406 – Texas Administrative Code. If the procedure is “medically necessary”, different healthcare consent laws may apply.

*NOTE: Practitioners have the right to refuse to perform a procedure, even with parental consent.

4. Appointments and Cancellations

  • All appointments must be scheduled in advance, either online, in person, or by phone. 
  • A non-refundable deposit may be required to secure your appointment. 
  • Cancellations or rescheduling require at least 48 hours’ notice. 
  • Late arrivals exceeding 15 minutes will result in a missed appointment. 
  • Missed appointments and failure to comply with the cancellation policy will result in forfeiture of your deposit. 
  • Rescheduled appointments will require a new deposit and a fee of 50% of the service price. The remaining balance will be due at the time of service.

Please note that we reserve the right to cancel or reschedule appointments due to unforeseen circumstances, and to refuse service at any time.

5. Payment

  • Payment is due at the time of service unless we have agreed otherwise.
  • We accept major credit cards, debit cards, and Zelle.
  • A deposit may be required to secure your booking.
  • Please note that a 3% charge will be added to all credit card payments.
  • Prices are subject to change without notice.

If you are using insurance, please be aware that you are responsible for any amounts not covered by your insurance.

6. Health and Safety

  • Our technicians maintain the highest hygiene and sanitation standards.
  • Permanent cosmetics and paramedical tattooing involve risks, including infection, allergic reactions, and scarring.
  • While we take precautions and adhere to strict hygiene standards, we are not liable for adverse reactions or complications. Specific results cannot be guaranteed.

7. Photo Release

  • You may be asked to sign a photo release allowing us to use your before-and-after photos for our portfolio, marketing, and educational purposes.

8. Intellectual Property

  • All website content and marketing materials are the property of Inked Elegance LLC and protected by copyright laws.

9. Limitation of Liability

  • Inked Elegance LLC is not liable for damages arising from the use of our services as permitted by law.
  • We do not guarantee specific results, as individual results vary based on personal circumstances, including after-care procedures.
  • Inked Elegance LLC, its employees, agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services as permitted by law.  

10. Indemnification

  • You agree to indemnify and hold harmless Inked Elegance LLC from any claims, damages, or expenses arising from your breach of these Terms and Conditions or your use of our services.

11. Governing Law

  • These Terms and Conditions are governed by the laws of the State of Texas. Disputes will be handled in the courts of Harris County, Texas.

12. Changes to Terms and Conditions

  • We reserve the right to modify these Terms and Conditions at any time, and changes will be posted on our website.   

13. Disclaimer

  • The services offered by Inked Elegance LLC are non-medical and not a replacement for medical advice, diagnosis, or treatment. Results may vary, and we do not make guarantees.
  • Clients must disclose all relevant medical conditions to Inked Elegance, LLC before treatment and consult their physician for any medical concerns before scheduling.

14. Client Acknowledgement

By signing our client consent form, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
